Driving is legal too.  However, it is a privilege, not a right.  Show me in the Constitution where there is a right to smoke.  There is a right to life - there is no right to smoke. 


I never said anything about my way or the highway.  I just pointed out that when your privilege interferes with other's rights, it is the privilege that will loose.  As a judge said one time, your right to swing your fits ends at my nose. 


Smoking is not a right.  If it was, cities, airplanes and work places could not ban it.  When is the last time you saw a ban on breathing?
